Güzelçamlı: Where Coastal, Forest and National-Park Rules Meet
1. Which Court Hears a Güzelçamlı Case
Güzelçamlı is a coastal settlement within the Söke district. Claims about land there are brought in the Söke courts (Code of Civil Procedure, Article 12: exclusive jurisdiction where the property lies), administrative claims go to the Aydın Administrative Court, and appeals go to the İzmir Regional Court of Appeal. Most owners live in Kuşadası, İzmir or abroad, so the file is run remotely under a power of attorney.
2. Three Overlapping Restrictions
A single parcel near the coast can be subject to three different regimes at once, and a buyer who checks only the title register sees none of them:
- Coastal Law (No. 3621). The shore is public property and cannot be privately owned; a title that covers it can be cancelled, and building is prohibited within at least 100 metres of the shoreline, measured from the coastal edge line.
- Forest regime. Land that is forest in law cannot be privately owned, and a clash between the forest cadastre and a title deed leads to cancellation claims.
- National Parks Law (No. 2873). Building in park areas depends on the approved plans; unlicensed structures face demolition and fines.
3. Treasury Title-Cancellation Claims
The Treasury or the Forestry Administration may sue to cancel a title on the ground that it covers forest or coastal land. The owner's main defences are the date on which the cadastral determination became final, the protection of a good-faith third party (Civil Code, Article 1023) and the limitation period. Where the land is genuinely coast or forest, these defences carry limited weight, so the point to check before purchase is whether the coastal edge line and forest boundary have been finally determined.
4. Seasonal Lettings and Buying
Holiday homes are commonly let by the season. Disputes about deposits and early eviction are decided under the Code of Obligations, Articles 342 to 352; the deposit must be returned when the tenant hands back the property in the agreed condition, and any deduction must be documented. For foreign purchasers, Article 35 of the Land Registry Law applies (nationality, military zones, total area), and the price should not be paid until the written check is complete. Frequently Asked Questions
Which court hears a property case in Güzelçamlı?
Güzelçamlı is within the Söke district; the case is brought before the Söke courts because jurisdiction over immovable property is exclusive to the court where the property lies. Administrative claims go to the Aydın Administrative Court.
Can a title near the shore be cancelled?
Yes. The shore is public property and cannot be privately owned, so a title that covers coastal land can be cancelled, and building is prohibited within at least 100 metres of the shoreline under the Coastal Law. Check whether the coastal edge line has been finally determined before you buy.
Can the Treasury cancel my title because the land is forest?
It can bring a claim. The owner's defences include the date the cadastral determination became final, the protection of a good-faith third party and limitation, but where the land is in law forest or coast they carry limited weight.
When must a holiday-rental deposit be returned?
Under the Code of Obligations, Articles 342 to 352, the deposit is returned when the tenant hands the property back in the agreed condition. The landlord who makes a deduction for damage or arrears must document it.
