Davutlar: Holiday Homes at the Edge of a National Park

1. Which Court Hears a Davutlar Case

Davutlar is a coastal settlement within the Söke district, not Kuşadası, even though most owners reach it from Kuşadası. Claims about land in Davutlar — cancellation of title, ending co-ownership, removal of an encroachment — must be brought in the Söke courts, because jurisdiction over immovable property is exclusive to the court where the property lies (Code of Civil Procedure, Article 12). Filing at Kuşadası simply produces a ruling that it has no jurisdiction and costs months.

Administrative claims, such as challenges to zoning refusals, demolition orders or administrative fines, go to the Aydın Administrative Court, and appeals from Söke judgments go to the İzmir Regional Court of Appeal. See our Kuşadası page for how to instruct us from abroad.

2. The National-Park Boundary

Part of Davutlar lies within the zone of the Dilek Peninsula–Büyük Menderes Delta National Park. Construction in national parks is governed by the National Parks Law (No. 2873) and the plans made under it, not by the ordinary zoning rules. A plot that is registered as land in the title register is not therefore a plot on which a permit can be obtained.

Before you pay a deposit, obtain in writing the plot's position relative to the park boundary, its zoning status and whether a building permit and occupancy permit exist. Without them you risk a demolition order, an administrative fine, and a building that cannot be converted to condominium title or resold with a mortgage.

3. Holiday-Site Management and Charges

Davutlar's sites are largely second homes occupied for part of the year. The disputes that follow are predictable: charges levied for expenses the management plan does not provide for, restrictions on pools and gardens, and enforcement against owners who are abroad. The management plan binds every owner and successor in title, and under Article 20 of the Condominium Law a buyer is jointly liable with the seller for unpaid common expenses, so obtain a clearance letter from the management before completing.

4. Buying as a Foreign National

Foreign acquisition is limited by Article 35 of the Land Registry Law (No. 2644): nationality, military or security zones and total area are checked before the transfer. Do not pay the price until the written check has been completed. For the detailed rules see our property-lawyer page and the citizenship-by-investment guide.

If you cannot attend, a power of attorney signed at a Turkish notary or consulate lets an attorney act for you. Documents validly served on a Turkish address start the time limits whether or not you read them, so keep the address current.

Frequently Asked Questions

Which court hears a property case in Davutlar?

Davutlar is within the Söke district, and jurisdiction over immovable property is exclusive to the court where the property lies. The case is therefore brought before the Söke courts, not at Kuşadası. Administrative claims go to the Aydın Administrative Court.

Can I build on a plot near the national park?

Not necessarily. Construction in national parks is governed by the National Parks Law (No. 2873) and the plans made under it. A plot that appears in the title register is not automatically buildable, so obtain the park boundary and zoning status in writing before paying anything.

Can a foreigner buy a house in Davutlar?

Yes, subject to Article 35 of the Land Registry Law: nationality, military or security zone status and the total area you would hold are checked before the transfer. Do not pay the price until that check has been completed in writing.

Am I liable for the previous owner's service charges?

Yes. Article 20 of the Condominium Law makes a buyer jointly liable with the seller for unpaid common expenses, and the management may enforce against the new owner with default interest. Obtain a clearance letter from the management first.
