The rapid development of internet technologies and digital financial payment systems has paved the way for the spread of illegal betting activities in Turkey. Today, through social media advertisements, sponsorships, or peer recommendations, many individuals unknowingly face serious administrative and criminal sanctions. These acts, commonly referred to as illegal betting or unlicensed gambling offenses, are subject to highly strict penalties under Turkish criminal law.

In Turkey, the authority to organize betting and games of chance based on sports competitions belongs exclusively to the Spor Toto Association. Any betting activity carried out through internet sites not licensed or authorized by this association is considered illegal. In light of our experience in representing clients facing illegal betting penalties in Kusadasi, Soke, Didim, and Aydin, we have detailed the legal procedures and penalties associated with illegal betting in this article.

1. Illegal Betting Offenses and Penalties Under Law No. 7258

In our country, illegal betting activities are penalized under Law No. 7258 on the Regulation of Betting and Games of Chance in Football and Other Sports Competitions. Article 5 of this law classifies actions related to illegal betting into different offense types and sanctions:
  • Operating or Facilitating Betting Offense (Art. 5/1-a): Those who operate or provide venues or opportunities for unlicensed sports betting or games of chance are sentenced to 3 to 5 years of imprisonment and an judicial fine of up to 10,000 days.
  • Providing Access to Overseas Betting Sites (Art. 5/1-c): Those who facilitate unlicensed betting from Turkey by providing access to games organized abroad face 4 to 6 years of imprisonment.
  • Intermediating Money Transfers (Art. 5/1-d): Those who intermediate the transport or transfer of illegal betting funds through bank accounts or crypto wallets are sentenced to 3 to 5 years of imprisonment and an judicial fine of up to 5,000 days.
  • Advertising and Encouraging Offense (Art. 5/1-ç): Imprisonment of 1 to 3 years is prescribed for those who advertise illegal betting sites or encourage and direct individuals to play these games.

2. Misdemeanor of Playing Unlicensed Betting and 2026 Administrative Fines

Playing illegal betting is a misdemeanor, not a crime under the Turkish Penal Code. Therefore, individuals who play illegal betting are not sentenced to prison or judicial fines; instead, they face administrative fines issued by local administrative authorities (Governorships or District Governorships).

As of 2026, the administrative fine for playing illegal betting ranges from 100,000 TL to 400,000 TL. The amount of the fine is determined by considering the frequency of play, the volume of transferred funds, and the individual's economic status. Since this fine is an administrative sanction, it is not recorded in the judicial registry (criminal record), but it is stored in official state administrative databases.

3. MASAK Bank Account Blocks and Law No. 5549 Process

One of the most common measures faced by individuals involved in illegal betting is the blocking of bank accounts. The Financial Crimes Investigation Board (MASAK) may temporarily suspend bank accounts containing suspicious transactions under Article 19/A of Law No. 5549 on the Prevention of Laundering Proceeds of Crime.

In this context, blockages are applied to bank accounts of individuals who send money to or receive payments from accounts associated with illegal betting sites. To lift the block, the administrative investigation must be completed, or legal objection procedures must be initiated before the Criminal Judge of Peace. It is critical to consult an experienced criminal defense attorney to review bank statements and request the release of blockages on legitimate income sources.

4. Security Clearance, Archive Research, and Impact on Civil Service

Although administrative fines for playing illegal betting are not recorded in the criminal registry, they can pose a serious obstacle under Security Clearance and Archive Research Law No. 7315. During security investigations, playing illegal betting or having financial transactions with unlicensed sites may be interpreted as "addiction to bad habits" or a "reliability" issue, leading to a negative evaluation of candidates applying for public service.

For active civil servants, playing unlicensed betting is subject to disciplinary investigations under Civil Servants Law No. 657, which can result in salary cuts or reprimands. 5. Appeal Process in Penal Court of Peace Against Fines

An appeal against the administrative fine issued by the local administrative authority must be filed before the Penal Court of Peace within 15 days from the date of notification. This period is strict, and the fine becomes final if the deadline is missed.

The objection petition must detail legal grounds such as the weakness of concrete evidence, transactions made outside the account owner's will (hacked accounts, unauthorized usage), financial transfers based on lawful debt relations, or fines determined contrary to the principle of individuality of punishment.
