A foreign national who wishes to stay in Türkiye for more than three months must obtain a residence permit (ikamet izni) before the visa or visa-exemption period runs out. Residence permits are governed by Law no. 6458 on Foreigners and International Protection. The choice of permit affects not just whether the application is accepted but also later renewals, family reunification, long-term permits and citizenship.
This guide covers the permit types, the conditions for the most commonly used short-term residence permit, when refusal, cancellation or non-renewal can follow, the position of foreign owners of Turkish property, and the legal routes against refusals. The explanations rest on the legislation as quoted in a Council of State decision; because rules change, current requirements should be confirmed with the Directorate of Migration Management before applying.
1. Types of Residence Permit
Under Law no. 6458 the main types are:
- Short-term residence permit: for foreigners who will stay for a specific purpose (property ownership, commercial connections, scientific research, in-service training and so on) (Art. 31).
- Family residence permit: for the spouse and children of a foreigner lawfully in Türkiye or of a Turkish citizen.
- Student residence permit: for foreigners studying in higher education or similar programmes.
- Long-term residence permit: an open-ended permit for foreigners who have resided in Türkiye for a certain period without interruption. The law sets this period at eight years.
- Humanitarian and victim-of-trafficking permits for special situations.
Those who come to work need a separate work permit, not a residence permit; see our guide on work permits for foreigners.
2. Conditions for the Short-Term Permit (Art. 32)
Under Article 32, the following are required for a short-term permit:
- Applying on one or more of the grounds listed in Art. 31/1 and submitting the related information and documents,
- Not falling within Article 7 (foreigners to whom entry is refused),
- Accommodation that meets general health and safety standards,
- If requested, a criminal record certificate issued by the authorities of the country of nationality or lawful residence,
- Giving the address at which the applicant will stay in Türkiye.
Applications in practice also require a valid passport, photographs, health insurance and documents showing the purpose of stay (for example a title deed, lease or company documents). Complete and current documents remove the most easily avoidable ground for refusal.
3. Grounds for Refusal, Cancellation and Non-Renewal (Art. 33)
A short-term permit is not granted, is cancelled if granted, and is not renewed on expiry where (Art. 33):
- One or more of the Article 32 conditions is not met or ceases to be met,
- The permit is found to have been used for a purpose other than that for which it was granted,
- The holder has spent more than 120 days in total outside Türkiye in the last year,
- A valid deportation or entry-ban decision exists against the holder.
The 120-day limit in particular is a common trap for foreigners who spend long periods abroad and then want to renew. Its exceptions and application are further regulated in the Implementing Regulation, so the current rules should be checked before applying.
4. Residence Permits for Foreign Property Owners
Article 31(b) provides that a short-term permit may be granted to those who own immovable property in Türkiye. Under the Implementing Regulation, the property must be a dwelling used as such; family members who hold shared or joint ownership of the dwelling may apply in the same way, and for family members who hold no ownership right the property serves only as evidence of financial means.
In a decision of 25.11.2020 the 10th Chamber of the Council of State held that foreigners who own a dwelling used as such in Türkiye may lawfully obtain a short-term permit on the basis of that property if they meet the other conditions. The same decision concluded that entry-restriction records that had been entered in the past and later cancelled cannot be a ground for refusal (see the precedent box below).
For foreigners buying a home in Kuşadası, Didim and the surrounding area, the title deed record, current health insurance and the address declaration are the core documents to have ready for the application.
5. Applying and Challenging a Refusal
Residence permit applications are submitted through the electronic application system and completed by appointment at the provincial migration management directorate. A renewal application must be made before the current permit expires; an application made after expiry can be treated as overstaying and may lead to an administrative fine and an entry ban.
- A refusal is an administrative act and can be challenged in an annulment action before the administrative court; the general time limit is 60 days from service. Where the decision also sets a short period for leaving the country (for example "10 days"), the action and the request for suspension of execution must be filed before that period expires.
- The time limit to challenge a deportation decision is much shorter (7 days), so the first thing to check is whether the refusal was served together with a deportation decision.
- The Council of State has stressed that in refusals the applicant's ground for the permit (for example property ownership) must be examined and that cancelled earlier records cannot serve as the reason.
6. Family, Student and Long-Term Permits: Points to Note
- Family permit: proof of marriage or parentage (apostilled and translated documents) and sufficient financial means of the sponsoring foreigner are needed.
- Student permit: the institution's acceptance or registration letter, continued student status and any work restrictions are considered.
- Long-term permit: the law requires eight years' uninterrupted residence together with conditions such as public order, no social assistance and sufficient regular income; the 120-day rule for short-term permits is especially important for continuity.
7. Common Mistakes
- Missing the permit expiry date: overstaying can lead to a fine and an entry ban.
- Overlooking more than 120 days abroad: the permit may not be renewed or may be cancelled.
- Using the permit for another purpose: working on a property-ownership permit, for example, leads to cancellation.
- Applying with missing or outdated documents: deed, insurance and address documents must be current at the application date.
- Receiving the refusal and missing the deadline to sue: the exit period set by the refusal and the filing deadline are calculated independently.
Frequently Asked Questions
For legal advice on residence permits, work permits, long-term permits and challenging refusals, see our Residency & Citizenship page, or request an appointment through our Contact page.
What types of residence permit exist in Türkiye?
Under Law no. 6458: short-term, family, student, long-term, humanitarian and victim-of-trafficking permits. Those who come to work need a separate work permit.
What are the conditions for a short-term residence permit?
Under Article 32: apply on a listed ground and submit the supporting documents, not fall within Article 7, have suitable accommodation, provide a criminal record certificate if asked, and give the address at which you will stay.
Can a foreigner who buys a home in Türkiye get a residence permit?
Yes. A short-term permit may be granted to those who own immovable property in Türkiye. Under the Implementing Regulation the property must be a dwelling used as such, and the other conditions must also be met. The 10th Chamber of the Council of State has confirmed this reading.
When is a residence permit cancelled or not renewed?
Where the required conditions are not met or cease to be met, the permit is used for another purpose, the holder has spent more than 120 days in total abroad in the last year, or a valid deportation or entry-ban decision exists.
My residence permit application was refused. What should I do?
A refusal is an administrative act that can be challenged by an annulment action before the administrative court; the general limit is 60 days from service. If the decision gives a short period for leaving the country, file the action and request suspension of execution before it expires. Deportation decisions have a much shorter time limit.
How long is needed for a long-term residence permit?
The law requires eight years of uninterrupted residence, as well as conditions such as public order and sufficient income. Stays abroad of more than 120 days during a short-term permit can raise continuity problems.
What happens if I miss my permit expiry date?
Staying beyond expiry can be treated as overstaying and lead to an administrative fine and an entry ban, so renewal applications should be made before the permit expires.
